No matter how it is viewed, as a plausible version of anti-utilitarianism or of non-consequentialist, or even as a plausible version of deontology, the theory of prima facie duties certainly makes W. D. Ross one of the most important moral philosopher of the twentieth-century. By outlining his pluralistic deontology, this paper attempts to argue for a positive answer to the question of whether Ross’s theory can offer a solution to the issue of conflicting duties. If such a solution is convincing, (...) as I believe it is, it would indicate the possibility to justify within the deontological framework, i.e., without committing to the principle of good-maximizing, those “hard cases” where people should break a promise or other (prima facie) duty in order to prevent a disastrous outcome. The theory of prima facie duties might then suggest that deontology and utilitarianism would likely be reconcilable. (shrink)

This paper attempts to answer whether the property of “efficacy” can be attributed to constitutive rules. In particular, according to Di Lucia, I will point out some problems that the “semantic conception of efficacy” has concerning constitutive and regulative rules. Then, the main goal of the paper will be to reflect on the possibility of the efficacy of constitutive rules by means of a complex case that the semantic conception seems to disregard: The case of the cheater. Does the action (...) of the cheater show the inefficacy of constitutive rules? Does she play the game while breaking the rule? Can the semantic conception of efficacy explain this situation, or do we need a more flexible concept of efficacy that takes nomotropism into account? These are some of the questions I will try to answer. (shrink)

The paper attempts to outline the actual academic debates around the concept of PR ethics. The first part aims to show the intimate link between professionalism and ethics as well as their bearing on the reputation of the PR field. Whether and how ethical public relations are possible is the main issue analyzed in the second part of the article. The two paradigms of public relations, “the attorney-adversary system” and “the two-way symmetrical model”, are put face to face in order (...) to better understand the arguments of their proponents as to the way of approaching to the ethical matters. A main concern of the third part is to answer the question if something is wrong with situational ethics. The problem is approached in the light of virtue ethics, which is itself situational in Aristotel’s sense of the term. In the final part, the paper suggests the possibility to use W. D. Ross’s pluralist deontology as a conceptual structure from which to build a practical model for the analysis of moral dilemmas in the PR practice. (shrink)

We take kelp as material entities immersed in a multitude of relations with other creatures (for whom kelp serves as both nourishment and shelter) and inorganic elements of the milieu it resides in, on the one hand, and as a figuration: a material-semiotic “map of contestable worlds” that encompasses entangled threads of “knowledge, practice and power” (Haraway 1997, 11) in its local and global sense, on the other. While drawing on our field notes from the congress and feminist posthumanities and (...) environmental humanities literatures (e.g. Alaimo 2016; Åsberg & Braidotti 2018; Sandilands & Erickson 2010; Iovino & Opperman 2014) – with a special focus on the so-called blue humanities/oceanic humanities (e.g. DeLoughrey 2019) – that unpack human/nonhuman relations in the context of the current environmental crisis and the accompanying “slow violence” (Nixon 2011), we mobilise a reflection on and make a proposal for “thinking with kelp” as a multi-faceted methodology of transversal and transdisciplinary knowledge production and practices: situated (Haraway 1988), enfleshed, transcorporeal (Alaimo 2010), collaborative, and committed to an ethics of multispecies response-ability (Haraway 2008). After identifying in Part I [1] a conceptual confusion (TCC), a Reality preconception (TRP1), and a fallacious dichotomy (TFD), the famous EPR/EPRB [2] [3] [4] [5] [6] argument for correlated ‘particles’ is now studied in the light of the Ontic Probability Interpretation of Quantum Theory (QT/TOPI). Another Reality preconception (TRP2) is found, showing that EPR used and ignored QT predictions in a single paralogism. Employing TFD and TRP2, EPR unveiled a contradiction veiled in its premises. By removing nonlocality from QT’s (...) Ontology [1] by fiat, EPR preordained its incompleteness. The Petitio Principii fallacy was at work from the outset. Einstein surmised the proper solution to his incompleteness/nonlocality dilemma in 1949 [7], but never abandoned his philosophical stance [8]. It is concluded that there are no definitions of Reality: we have to accept that Reality may not conform to our prejudices and, if an otherwise successful theory predicts what we do not believe in, no gedankenexperiment will help because our biases may slither through. Only actual experiments could assist in solving Einstein’s dilemma, as has been proven in the last 50 years. Notwithstanding, EPR is one of the most influential papers in history and has immensely sparked both conceptual and technological progress. Part III of this series further develops QT/TOPI, while scrutinizing the mythical ‘Schrödinger’s Cat’, as well as the ‘Basis’ and ‘Measurement’ pseudo-problems [9]. Part IV introduces QR/TOPI: a new theory that solves the century-old problem of integrating Special Relativity with Quantum Theory [10]. (shrink)

The Protein Ontology provides terms for and supports annotation of species-specific protein complexes in an ontology framework that relates them both to their components and to species-independent families of complexes. Comprehensive curation of experimentally known forms and annotations thereof is expected to expose discrepancies, differences, and gaps in our knowledge. We have annotated the early events of innate immune signaling mediated by Toll-Like Receptor 3 and 4 complexes in human, mouse, and chicken. The resulting ontology and annotation data set has (...) allowed us to identify species-specific gaps in experimental data and possible functional differences between species, and to employ inferred structural and functional relationships to suggest plausible resolutions of these discrepancies and gaps. In this paper we study the connection between the use of evaluative language and the building of both personal and social identities, from the perspective of Dynamical System Theory . We primarily discuss two issues: 1) The use of evaluation (in the sense given to the term by Alba-Juez and Thompson (forthcoming)) as a means to the construction of both individual and group identities, thus exploring how the connection between linguistic choices and social identities is shaped by interactional needs (...) for stancetaking. In order to illustrate this connection, we examine examples of the use of evaluative language in a web social network, and we analyze some of the discourse elements showing ways of positioning that act as catalysts for the emergence of a multifactorial dynamic system of identities. 2) The consideration of Dynamical System Theory (DST) as a theoretical framework for the modeling of language and identity. Although originally a mathematical theory, DST has been adopted by cognitive science as a valid framework for the study of cognitive phenomena, on the grounds that natural cognition is a dynamical phenomenon. Within the realm of (socio) linguistics and pragmatics, this study is to a certain degree in line with some recent studies such as Gibbs (2010), Geeraerts, Kristiansen and Peirsman (2010), or Moreno Fernández (2012). Thus, we herein focus on how linguistic evaluation intervenes in the intricate dynamical system of identity, and even though we do not engage in complex mathematical disquisition, we argue that the idea and philosophical foundation underlying DST can lead us towards the ‘integration’ of the complex equation of identity construction, and that consequently the field has great potential for further research. Emotions are an integral part of human cognition and they guide not only our understanding of the world but also our actions within it. As such, whether we soothe or flame an emotion is not inconsequential. Recent work in conversational AI has focused on responding empathetically to users, validating and soothing their emotions without a real basis. This AI-aided emotional regulation can have negative consequences for users and society, tending towards a one-noted happiness defined as only the absence of "negative" (...) emotions. We argue that we must carefully consider whether and how to respond to users' emotions. (shrink)

This paper explores the ways in which Cordwainer Smith’s short story “Under Old Earth” problematizes emotions, who/what has them, and who/what is granted moral status. Most importantly, however, “Under Old Earth” questions the primacy of happiness in human society, especially where happiness is understood as the absence of other (negative) emotions. As such, “Under Old Earth” challenges the notion, widely held in contemporary ethics, that our moral obligation to one another is mediated through the goal of the attainment of happiness. (...) Through this challenge, Smith’s short story speaks directly to the current understanding of emotion in the field of AI, and complicates what the goal of affective computing should be. (shrink)

La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. As the planet’s largest ecosystem, oceans stabilise climate, produce oxygen, store CO2 and host unfathomable biodiversity at a deep time-scale. In recent decades, scientific assessments have indicated that the oceans are seriously degraded to the detriment of most near-future societies. Human-induced impacts range from climate change, ocean acidification, loss of biodiversity, eutrophication and marine pollution to local degradation of marine and coastal environments. Such environmental violence takes form of both ‘spectacular’ events, like oil spills and ‘slow violence’, occurring gradually and (...) out of sight. The purpose of this paper is to show four cases of coastal and marine forms of slow violence and to provide counter-accounts of how to reinvent our consumer imaginary at such locations, as well as to develop what is here referred to as ‘low-trophic theory,’ a situated ethical stance that attends to entanglements of consumption, food, violence, environmental adaptability and more-than-human care from the co-existential perspective of multispecies ethics. We combine field-philosophical case studies with insights from marine science, environmental art and cultural practices in the Baltic and North Sea region and feminist posthumanities. The paper shows that the oceanic imaginary is not a unified place, but rather, a set of forces, which requires renewed ethical approaches, conceptual inventiveness and practical creativity. Based on the case studies and examples presented, the authors conclude that the consideration of more-than-human ethical perspectives, provided by environmental arts and humanities is crucial for both research on nature and space, and for the flourishing of local multispecies communities. This paper thus inaugurates thinking and practice along the proposed here ethical stance of low-trophic theory, developed it along the methodological lines of feminist environmental posthumanities. The Protein Ontology (PRO) is designed as a formal and principled Open Biomedical Ontologies (OBO) Foundry ontology for proteins. The components of PRO extend from a classification of proteins on the basis of evolutionary relationships at the homeomorphic level to the representation of the multiple protein forms of a gene, including those resulting from alternative splicing, cleavage and/or posttranslational modifications. Focusing specifically on the TGF-beta signaling proteins, we describe the building, curation, usage and dissemination of PRO. PRO provides a framework (...) for the formal representation of protein classes and protein forms in the OBO Foundry. It is designed to enable data retrieval and integration and machine reasoning at the molecular level of proteins, thereby facilitating cross-species comparisons, pathway analysis, disease modeling and the generation of new hypotheses. En el marco del V Congreso Internacional «La actualidad de Michel Foucault» celebrado en la Universidad Complutense de Madrid entre el 6 y el 8 de marzo de 2018, sostuvimos una interesante conversación con Daniel Lorenzini, investigador del pensamiento ético y político de Michel Foucault y editor de varios de sus cursos y conferencias publicadas en los últimos años en Francia. Discutimos sobre el estado actual de los archivos de Foucault adquiridos por la Biblioteca Nacional de Francia (BnF), algunos de (...) los diversos proyectos editoriales que se derivan del trabajo de archivo y análisis de los manuscritos del filósofo, la reciente e inesperada publicación de Les aveux de la chair y su relación con el proyecto de la Historia de la sexualidad tal como fue planteado en 1976, la relación de Foucault con Nietzsche respecto a sus lecturas de la subjetivación y el vínculo, no siempre evidente, entre ética y política a la luz de sus investigaciones sobre el filósofo francés. En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. For philosophy to criticize the concept of reality requires self-criticism. Throughout history many thinkers that have systematized a critique of both reality and philosophy. In this article we will analyze the Kantian and Hegelian systems by showing the failure in their respective critique to exercise sufficient self-criticism, resulting in unfinished critiques. Going a step further, Tanabe’s proposal was to plunge philosophy into a kind of «absolute disruption» that would drive thought beyond itself by means of an absolute critique in which (...) being and nothingness are seen to interpenetrate each other, thus opening up the possibility of positing absolute nothingness as «a foundation that is not a foundation.». The Protein Ontology (PRO) web resource provides an integrative framework for protein-centric exploration and enables specific and precise annotation of proteins and protein complexes based on PRO. Functionalities include: browsing, searching and retrieving, terms, displaying selected terms in OBO or OWL format, and supporting URIs. In addition, the PRO website offers multiple ways for the user to request, submit, or modify terms and/or annotation. We will demonstrate the use of these tools for protein research and annotation.

We have ignored for a century that the incompleteness of Quantum Theory (QT) is inseparable from the incompleteness of Special Relativity (RT). In this article, I claim that the latter has been gravely incomplete vis à vis the former from 1927 until today. But completing RT in the light of QT is not as simple as merely postulating nonlocality and stochasticity as “elements of reality” (which is de facto done by most physicists and pragmatic philosophers); otherwise, RT would not still (...) be in a “peaceful” conflict with QT after a century. Vice versa, I contend that QT is incomplete vis à vis RT, though not for the reasons claimed in the iconic EPR paper. We then show how to complete the Ontology, Foundation, and Structure of both RT and QT and merge them into an internally consistent embracive theory I call QR/TOPI. This theory offers a more cogent and simpler avenue to integrate RT with QT than positing exotic causal structures like ‘retrocausality’, ‘future-input dependence’, ‘superdeterminism’ – not to mention the extravagant ‘Many-Worlds’, ‘Many-Minds’, ‘Parallel-Lives’, and other interpretations of QT like Many-Histories, QBism, etc. -/- QR/TOPI provides the “radical conceptual renewal” wished by John Bell so as to integrate probability and nonlocality into an upgraded RT and, reciprocally, to integrate Frame-Invariance into QT while at the same time, as demanded by 2022 Nobel laureate Anton Zeilinger, providing basic physical meaning to the resulting encompassing theory. The old outcast notion of absolute simultaneity is resurrected without any conflict with Einstein’s relative simultaneity, while Frame-Invariance is preserved via our Quantumlike Transformation (QLT), which is an extension of the Lorentz Transformation (LT): QLT includes what LT excludes: nonlocality. -/- Section 1 examines the philosophical foundations of Space and Time, focusing on RT, its plethora of empirical validations, and the tenets which make it incompatible with QT. Section 2 incorporates stochasticity into RT. Sections 3 through 5 gradually introduce QR/TOPI for mono-, bi-, and tri-quanton systems, with full consideration of Bell Theorem, nonlocality, teleportation, and their implications. Section 6 attempts to review the current status quo. Section 7 makes the case for the incompleteness of RT and QT. Section 8 explains how to complete and integrate both theories so as to formally develop QR/TOPI. Finally, in Section 9, via multiple experimental setups, I zero in on Zeilinger’s basic question: “what does this really mean in a basic way?”. (shrink)

Los intereses contrapuestos en relación con el manejo, uso, utilización y aprovechamiento de los recursos naturales de los territorios indígenas, generan conflictos ambientales en donde uno de los escenarios privilegiados de expresión de los mismos es el de la consulta previa: cuando se adelanta o por el contrario, cuando aunque sea obligatoria, no se impulsa o se hace de manera inadecuada, es decir, sin el cumplimiento de los requisitos mínimos establecidos.

What makes fast, cumulative cultural evolution work? Where did it come from? Why is it the sole preserve of humans? We set out a self-assembly hypothesis: cultural evolution evolved culturally. We present an evolutionary account that shows this hypothesis to be coherent, plausible, and worthy of further investigation. It has the following steps: (0) in common with other animals, early hominins had significant capacity for social learning; (1) knowledge and skills learned by offspring from their parents began to spread because (...) bearers had more offspring, a process we call CS1 (or Cultural Selection 1); (2) CS1 shaped attentional learning biases; (3) these attentional biases were augmented by explicit learning biases (judgements about what should be copied from whom). Explicit learning biases enabled (4) the high-fidelity, exclusive copying required for fast cultural accumulation of knowledge and skills by a process we call CS2 (or Cultural Selection 2), and (5) the emergence of cognitive processes such as imitation, mindreading and metacognition – ‘cognitive gadgets’ specialised for cultural learning. This self-assembly hypothesis is consistent with archaeological evidence that the stone tools used by early hominins were not dependent on fast, cumulative cultural evolution, and suggests new priorities for research on ‘animal culture’. Quality education needs quality teachers to achieve success. Thus, this study determined the factors related to the teachers’ performance in delivering the K to 12 Curriculum in the Narra del Sur district, Palawan, Philippines. A descriptive-correlational research design was employed, with a sample of 132 randomly selected public elementary teachers. The study used frequency counts and percentages, arithmetic mean and standard deviation, and Spearman’s rho to analyze and draw conclusions from the data. The findings revealed a correlation between the respondents’ (...) age and their utilization of teaching materials and ICT. The number of pupils taught was correlated with teachers’ commitment, while number of pupils taught, position, highest educational attainment, and length of service were related to the respondents’ performance. The main problem encountered by the respondents was excessive workloads, paperwork, and reports. To solve the problem teachers encountered in delivering the K to 12 Curriculum, the respondents preferred preparing a work plan and allocating time to daily and weekly tasks to avoid excessive workloads. These results may aid policymakers and curriculum developers in the Department of Education to make relevant enhancements to the factors that affect teachers’ performance in curriculum delivery. Marietta Radomska ja Cecilia Åsberg ehdottavat suunnaksi biofilosofiaa, jossa elämistä ja kuolemista tarkastellaan yhteen kietoutuneina ja yhdessä muuttuvina.

Este paper examina en detalle el marco constitucional dispuesto en 1991 para la protección del medio ambiente y la configuración del Estado colombiano frente a los nuevos retos que plantea la protección ambiental. Lo anterior, a partir de dos elementos claves para entender el papel de los mecanismos jurídicos en la defensa de la naturaleza y el ambiente: la participación ambiental y el acceso a la justicia ambiental, ello, con el fin de conocer los instrumentos que reconfiguran el Estado para (...) que la ciudadanía y las organizaciones sociales puedan ejercer una defensa jurídica del medio ambiente, que aporte a la construcción de la justicia ambiental. En el presente artículo se presenta el panorama y algunos de los más importantes avances que en Colombia se han dado en materia ambiental desde la Constitución Política de 1991. La metodología llevada a cabo es descriptiva y analítica, en tanto se estudian no sólo las normas sino las sentencias más relevantes que se han constituido en un hito en la protección de los derechos ambientales. En tal sentido, lo que se pretende evidenciar es la existencia de un panorama de (...) constitucionalización de los derechos ambientales con signicativos avances tales como el rol preponderante que ha adquirido el principio de precaución o el reconocimiento de la función ecológica de la propiedad. Biomedical ontologies are emerging as critical tools in genomic and proteomic research where complex data in disparate resources need to be integrated. A number of ontologies exist that describe the properties that can be attributed to proteins; for example, protein functions are described by Gene Ontology, while human diseases are described by Disease Ontology. There is, however, a gap in the current set of ontologies—one that describes the protein entities themselves and their relationships. We have designed a PRotein Ontology (PRO) (...) to facilitate protein annotation and to guide new experiments. The components of PRO extend from the classification of proteins on the basis of evolutionary relationships to the representation of the multiple protein forms of a gene (products generated by genetic variation, alternative splicing, proteolytic cleavage, and other post-translational modification). PRO will allow the specification of relationships between PRO, GO and other OBO Foundry ontologies. Here we describe the initial development of PRO, illustrated using human proteins from the TGF-beta signaling pathway. (shrink)

En este texto se presenta un espacio de intercambio de conocimientos desde una perspectiva científica, técnica y jurídica, para contribuir a la protección de los recursos naturales. Debido a la importancia de establecer mecanismos para proteger la biodiversidad y posibilitar la preservación de los conocimientos asociados especialmente al uso de la flora medicinal, la Línea de Investigación en Política y Legislación, del Grupo de Estudios en Sistemas Tradicionales de Salud de la Facultad de Medicina, y la Línea de Derecho Ambiental (...) y Grupos Étnicos, del Grupo de Derechos Humanos de Jurisprudencia de la Universidad del Rosario, desarrollaron este libro a través del cual la Universidad se propone profundizar en el panorama actual de la reglamentación y política –Internacional, nacional y local—respecto a la flora medicinal y al patrimonio cultural inmaterial asociado a ésta. En la vida democrática moderna la participación ha adquirido una importancia fundamental. La idea de la participación indirecta y del papel inactivo de las personas y de las comunidades mostró su carácter insuficiente para resolver las complejidades de los asuntos contemporáneos y las necesidades de las naciones. Los cambios que se han dado en los últimos tiempos proponen un Estado que se relaciona de manera más directa con el ciudadano, con el cual toma además las decisiones a través de procedimientos (...) de incidencia real y eficiente. La participación pasa a ocupar un puesto muy importante en la gestión del Estado, no solo en lo que tiene que ver con la toma de decisiones, sino también con la cogestión, el seguimiento y la evaluación de las mismas. Sin embargo, no basta con que el derecho a la participación sea reconocido: también se hace necesario el establecimiento de escenarios para su ejercicio como una obligación por parte del Estado. La participación es el cimiento del Estado y de la democracia; un deber y un derecho que se sustenta en el principio de solidaridad y en la unión de las comunidades en pos de un objetivo o de la integración de todas las personas en la construcción de un mejor país. El derecho a la participación es un derecho de primera generación correspondiente a los derechos civiles y políticos. En temas ambientales, una regla importante para orientar la actividad del Estado es la incidencia ciudadana en todos los ámbitos, desde las acciones de ordenamiento ambiental hasta las que tienen que ver con la investigación, con programas de control y protección de recursos, en el otorgamiento de licencias y permisos ambientales y en la planeación ambiental, entre otros. De esto se ha tenido conciencia desde la expedición del Código de Recursos Naturales en 1974, cuando se señaló que la actividad del Estado debería inducir a un manejo participativo, por cuanto se postula como regla de administración que debe promoverse la formación de asociaciones y de grupos cívicos para lograr la protección de los recursos naturales renovables y su utilización adecuada, con base en el estudio de las relaciones de la comunidad con tales recursos. Este proyecto responde a un momento histórico de gran importancia, que por supuesto no pudo ser más oportuno. Colombia celebra en el año 2006 los quince años de la promulgación de su Constitución Política, y los cambios de trascendentales surgidos a partir de su aplicación has sido prolíficos, Particularmente, el tema ambiental ha sobresalido dentro de las grandes transformaciones del país, y por ello no en vano hoy se afirma que tenemos una verdades Constitución ecológica. De igual forma, la Facultad (...) de Jurisprudencia de la Universidad del Rosario conmemora los die años de la creación de la especialización en Derecho Ambiental, y tal coincidencia histórica fue una motivación adicional para proponer la realización de un análisis de la evolución normativa surtida para proponer la realización de un análisis de la evolución normativa surtida en este decenio, una evaluación de la gestión ambiental colombiana y de sus distintos impactos en una sociedad que cuenta hoy en día con herramientas constitucionales legales para la defensa de sus derechos e interese colectivos. La Universidad del Rosario ha sido parte de esta evolución, desarrollando un rol activo con el cual se han abierto espacios de discusión y de proposición de alternativas, herramientas y experiencias en pro de la protección integral de la diversidad étnica, cultural y natural de la Nación colombiana. Así, se ha constituido como facilitadora del proceso de la formación de los nuevos actores y ha tenido gran posicionamiento en procesos de participación y de estructuración de proyectos institucionales ambientales. El derecho internacional surgió para regular las relaciones entre Estados, dejando por fuera a otro tipo de organizaciones, comunidades y personas. Con el paso del tiempo, se fue ampliando la posibilidad de hacer parte en esos escenarios restringidos cuando surgieron las organizaciones internacionales que son creadas por los Estaos, que tienen la capacidad de participar en las relaciones internacionales de manera limitada. Posteriormente el derecho internacional ha dejado participar con ciertas restricciones, a las Organizaciones no Gubernamentales - ONG y a (...) las personas. Los pueblos indígenas, a pesar de contar con más de 300 millones de personas alrededor del mundo y de contribuir con la diversidad cultural y la protección de la biodiversidad, han sido ignorados y excluidos de los escenarios internacionales. Sin embargo después de un largo y lento proceso de reivindicación han logrado hacer sentir su voz y hoy en día han empezado a ser considerados en algunos de estos escenarios internacionales. En este documento se presentará un breve recuento de algunos de esos espacios en el ámbito de los organismos internacionales, en donde se han desarrollado temas relativos al medio ambiento en los cuales tienen interés los pueblos indígenas. *El mismo se encuentra dividido en dos partes, la primera corresponde a los organismos internacionales universales que involucran la Organización de Naciones Unidad ONU y sus diferentes órganos y organismos especializados en temáticas ambientales. ** Además hace referencia a las declaraciones y los principales convenios internacionales sobre medio ambiente y conocimiento tradicional, adicionalmente se incluyen las organizaciones y acuerdos conexos que corresponden a la Organización Mundial del Comercio y a los tratados de libre comercio. La segunda parte corresponde a los escenarios de protección del medio ambiente a nivel regional que son relevantes para los pueblos indígenas, entre ellos, la Organización de Estados Americanos OEA, el Bando Interamericano de Desarrollo BID, la Organización Panamericana de la Salud OPS, la Comunidad Andina de Naciones CAN y se incluyen adicionalmente los tratados y declaraciones importantes en la materia. El objetivo al realizar este documento es ofrecer un panorama sobre las funciones de estos organismos y mencionar la manera como puede darse la participación de los pueblos indígenas en los mismos, mediante una obra de divulgación que sirva como material de consulta para líderes, autoridades de pueblos y organizaciones indígenas, funcionarios de organizaciones internacionales y sociales que apoyan a los pueblos indígenas. Si bien al hablar de igualdad y derechos colectivos nos situamos aparentemente en dos espectros distintos de los derechos humanos, siguiendo a VASAK y su teoría de las tres generaciones, de un lado en el rango de un derecho fundamental, y del otro, en toda una amplia gama de derechos de tercera generación, es en realidad, en una misma órbita en donde debemos ubicarnos: en la del Estado de Social Derecho. Y es allí, donde la capacidad que éste tenga para (...) hacer frente a los desafíos que trae consigo su cumplimiento -sin olvidar el de los derechos económicos, sociales y culturales-, se convierte en el mejor elemento de juicio para determinar su éxito o fracaso, en una sociedad fracturada por un sinnúmero de fenómenos que atentan cada vez más contra las garantías y libertades de los ciudadanos. En este contexto, en el marco del programa de actividades formativas del Doctorado en Estudios Interdisciplinares de Género y Políticas de Igualdad, se organizó un Foro Académico cuya pretensión no era otra sino la de presentar a la comunidad una serie de reflexiones sobre algunos de estos mencionados fenómenos, a partir de la visión aquí propuesta. The aim of this study was to investigate the predictive relationship of peer group influence, teacher-student interaction and indiscipline to students' dropout tendency in evening continuing education programmes. The context of this study is the southern senatorial district of Cross River State, Nigeria. The study adopted a predictive correlational research design, and the sample comprised 554 students randomly selected from 11 centres in the district. This represents 20% of the total population of students. The instrument used for data collection was (...) a questionnaire titled: "Social Indicators and Dropout Tendency Scale" (SIDTS). The researchers collected the data that were analysed using Pearson product-moment correlation and multiple linear regression analyses at the .05 level of significance. The results revealed that peer group influence, teacher-student interaction and level of indiscipline collectively and individually predicted dropout tendency among students in evening continuing education programmes. It was recommended, among others, that the teachers discover diverse ways of making their teaching process lively by devising ways of engaging the students in the learning process by forming discussion groups that will promote healthy peer groups, which will increase their eagerness to come to school. Globalisation has brought immense changes to the national and international economic structure. The digital revolution and ICT expansion positively impacted the sharing economy development. In this regard, the most avant-garde countries in sharing economy seem to be the advanced countries. However, transitory countries such as Albania are making satisfactory progress as well. While being part of some global cases of sharing economy, Albania is also experiencing domestic incentives related with. The sectors involved in sharing economy are affiliated to different domains, (...) including agriculture, tourism, healthcare, transportation, etc. Albania strongly embraced technology because of its relatively young population and the flexible education system adopting to the market needs. The Albanian government is doing well on the promotion and usage of public platforms, which are supportive of the sharing concept. Although not specifically for the sharing economy, the government of Albania has released some useful strategic plans to embed the necessary instruments and infrastructure to digitalisation. However, there is more to do for sharing economy in specific terms. The collaboration of three actors, businesses-academia-government, would bring to the Albanian market new capacities and additional added values. (shrink)

Initially focused on proteins found in human, mouse and Escherichia coli, PRO now includes representations of protein complexes. The PRO Consortium works in concert with the developers of other biomedical ontologies and protein knowledge bases to provide the ability to formally organize and integrate representations of precise protein forms so as to enhance accessibility to results of protein (...) research. For that goal, we will briefly explore certain ideas from his Political Treatise –of course, with the help of other works, like the Tractatus Theologico-Politicus and the Ethics. We will deal with ideas like «natural law», «State», «Freedom», and other ideas that may arise from those and in which construction, they dialectically criticize and destroy others –v.g., «People», «Will», «absolute monarchy» and so on. Most of us are either philosophically naïve scientists or scientifically naïve philosophers, so we misjudged Schrödinger’s “very burlesque” portrait of Quantum Theory (QT) as a profound conundrum. The clear signs of a strawman argument were ignored. The Ontic Probability Interpretation (TOPI) is a metatheory: a theory about the meaning of QT. Ironically, equating Reality with Actuality cannot explain actual data, justifying the century-long philosophical struggle. The actual is real but not everything real is actual. The ontic character of the Probable (...) has been elusive for so long because it cannot be grasped directly from experiment; it can only be inferred from physical setups that do not morph it into the Actual. In this Part III, Born’s Rule and the quantum formalism for the microworld are intuitively surmised from instances in our macroworld. The posited reality of the quanton’s probable states and properties is probed and proved. After almost a century, TOPI aims at setting the record straight: the so-called ‘Basis’ and ‘Measurement’ problems are ill-advised. About the first, all bases are legitimate regardless of state and milieu. As for the second, its premise is false: there is no need for a physical ‘collapse’ process that would convert many states into a single state. Under TOPI, a more sensible variant of the ‘measurement problem’ can be reformulated in non-anthropic terms as a real problem. Yet, as such, it is not part of QT per se and will be tackled in future papers. As for the mythical cat, the ontic state of a radioactive nucleus is not pure, so its evolution is not governed by Schrödinger’s equation – let alone the rest of his “hellish machine”. Einstein was right: “The Lord is subtle but not malicious”. However, ‘The Lord’ turned out to be much subtler than what Einstein and Schrödinger could have ever accepted. Part IV introduces QR/TOPI: a new theory that solves the century-old problem of integrating Special Relativity with Quantum Theory [1]. (shrink)

Ignited by Einstein and Bohr a century ago, the philosophical struggle about Reality is yet unfinished, with no signs of a swift resolution. Despite vast technological progress fueled by the iconic Einstein/Podolsky/Rosen paper (EPR) [1] [2] [3], the intricate link between ontic and epistemic aspects of Quantum Theory (QT) has greatly hindered our grip on Reality and further progress in physical theory. Fallacies concealed by tortuous logical negations made EPR comprehension much harder than it could have been had Einstein written (...) it himself in German. EPR is plagued with preconceptions about what a physical property is, the 'Uncertainty Principle', and the Principle of Locality. Numerous interpretations of QT vis à vis Reality exist and are keenly disputed [4] [5] [6] [7] [8] [9] [10] [11]. This is the first of a series of articles arguing for a novel physical interpretation I call ‘The Ontic Probability Interpretation’ (TOPI). A gradual explanation of TOPI is given intertwined with a meticulous logico-philosophical scrutiny of EPR, with Part I focusing on the meaning of Einstein’s ‘incompleteness’ claim for QT: a conceptual confusion, a preconception about Reality, and a flawed dichotomy are shown to be severe obstacles for the EPR argument to succeed. Part II completes the analysis, proving EPR claim of ‘incompleteness’ for QT is fallacious [12]. Part III further develops TOPI, while scrutinizing the mythical ‘Schrödinger’s Cat’, as well as the ‘Basis’ and ‘Measurement’ pseudo-problems [13]. The advancement of technology has tremendously transformed today’s teaching and learning. Teachers have a plethora of ways to keep students engaged and empowered. Technology allows both students and teachers to interact better and more effectively. Changing student demography, changing teaching paradigms, and changing needs of today’s students necessitate the integration of technology in the universities. Universities undoubtedly have to seek innovative methods in delivering courses to increase students’ engagement and to attain their teaching goals. This proceeding is a collection of (...) papers presented in the International Conference on Innovation in Education: Challenges and Opportunities in Southeast Asia. Co-presented by the United board and Soegijapranata Catholic University, the conference discussed the unique challenges and opportunities facing the Asian region, with sessions designed to highlight the innovative ways in which colleges and universities leverage technological advances for the promotion of whole person education. The themes in this conference centers around massive open online course, online, distance, virtual, and augmented reality learning, faculty development and digital pedagogy, social media and social networking in education. In the first part of the proceeding, the papers focus on various online, distance, virtual, augmented reality-based methods used to engage students in the classrooms. In the second part of the proceeding, the papers center on the innovative ways to deliver course materials. The papers in the last part of the proceeding highlight how social media and social networking are adopted in the classroom. We hope that the insights and ideas put forward in this proceeding will greatly contribute to the scholarly discussions of how digital technology is adopted to meet the needs of today’s young generations and teachers in the universities. Emotions are a central aspect of communication. Consequently, emotion analysis (EA) is a rapidly growing field in natural language processing (NLP). However, there is no consensus on scope, direction, or methods. In this paper, we conduct a thorough review of 154 relevant NLP publications from the last decade. Based on this review, we address four different questions: (1) How are EA tasks defined in NLP? (2) What are the most prominent emotion frameworks and which emotions are modeled? (3) Is the (...) subjectivity of emotions considered in terms of demographics and cultural factors? and (4) What are the primary NLP applications for EA? We take stock of trends in EA and tasks, emotion frameworks used, existing datasets, methods, and applications. We then discuss four lacunae: (1) the absence of demographic and cultural aspects does not account for the variation in how emotions are perceived, but instead assumes they are universally experienced in the same manner; (2) the poor fit of emotion categories from the two main emotion theories to the task; (3) the lack of standardized EA terminology hinders gap identification, comparison, and future goals; and (4) the absence of interdisciplinary research isolates EA from insights in other fields. Our work will enable more focused research into EA and a more holistic approach to modeling emotions in NLP. (shrink)

The Cell Ontology (CL) is designed to provide a standardized representation of cell types for data annotation. Currently, the CL employs multiple is_a relations, defining cell types in terms of histological, functional, and lineage properties, and the majority of definitions are written with sufficient generality to hold across multiple species. This approach limits the CL’s utility for cross-species data integration. To address this problem, we developed a method for the ontological representation of cells and applied this method to develop a (...) dendritic cell ontology (DC-CL). DC-CL subtypes are delineated on the basis of surface protein expression, systematically including both species-general and species-specific types and optimizing DC-CL for the analysis of flow cytometry data. The Protein Ontology (PRO; http://proconsortium.org) formally defines protein entities and explicitly represents their major forms and interrelations. Protein entities represented in PRO corresponding to single amino acid chains are categorized by level of specificity into family, gene, sequence and modification metaclasses, and there is a separate metaclass for protein complexes. All metaclasses also have organism-specific derivatives. PRO complements established sequence databases such as UniProtKB, and interoperates with other biomedical and biological ontologies such as the Gene Ontology (GO). PRO relates to (...) UniProtKB in that PRO’s organism-specific classes of proteins encoded by a specific gene correspond to entities documented in UniProtKB entries. PRO relates to the GO in that PRO’s representations of organism-specific protein complexes are subclasses of the organism-agnostic protein complex terms in the GO Cellular Component Ontology. The past few years have seen growth and changes to the PRO, as well as new points of access to the data and new applications of PRO in immunology and proteomics. The performance in the delivery of environmental management programs of the local government of Lezo, Aklan, Philippines was evaluated in this study. Through the Multi-Stage Random Probability Sampling technique, 150 respondents from barangays’ share in the municipal population were determined based on the Philippine Statistical Authority’s Data on Census Population and Housing for the 2015. The probability respondents were selected using the Kish Grid where female respondents were given even numbered questionnaires while male respondents were assigned odd numbers. The four (...) major core concepts namely awareness, availment, satisfaction and need for action were used in measuring the ratings presented in frequency and percentage distributions. Interview was also conducted to gather reasons for their ratings. The study inferred that majority of the respondents were highly aware of the community-based greening project. However, low awareness was attained on projects such as air pollution control program and waste-water management. A high percentage of respondents have availed the environmental management programs except for solid waste management. Overall, majority of the respondents were satisfied of the environmental management programs rendered by the local government unit and therefore needs less action. It is recommended that the local government unit strengthen air pollution control program. (shrink)

A 25 años de su muerte, los escritos de Louis Althusser continúan siendo tan polémicos y controvertidos como lo fueron en el momento de su publicación. La siguiente investigación se propone analizar uno de los temas que más controversias y críticas suscitó en la década de los sesenta, momento por demás polémico dentro de su producción intelectual: la relación entre la ciencia e ideología. ¿Se trata de una llana oposición?, ¿son la ciencia y la ideología dos estructuras claramente diferenciadas?, ¿es (...) acaso la ciencia la salida de la ideología?, ¿es la ciencia la verdad y la ideología el error? A través de un estudio pormenorizado de los textos publicados en la década señalada, este trabajo buscará dar cuenta del pensamiento de Althusser en relación con esta temática en el marco de sus valiosos aportes al pensamiento marxista. -/- .
